Acceptable Usage Policy (AUP)

This AUP governs the use of TruDigits' hosting services. Violation of this AUP may result in suspension or termination of your service. In the event of a dispute between you and TruDigits regarding the interpretation of this AUP, TruDigits interpretation, in its reasonable commercial judgment, shall govern. Offensive Content

You may NOT publish or transmit via TruDigits' service any content that TruDigits reasonably believes:

  1. Constitutes child pornography
  2. Constitutes pornography
  3. Is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech
  4. Is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes
  5. Is defamatory or violates a person's privacy
  6. Creates a risk to a person's safety or health, creates a risk to public safety or health, compromises national security, or interferes with a investigation by law enforcement
  7. Improperly exposes trade secrets or other confidential or proprietary information of another person
  8. Is intended to assist others in defeating technical copyright protections
  9. Clearly infringes on another person's trade or service mark, patent, or other property right
  10. Promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking
  11. Is a peer 2 peer file sharing application such as Kazaa, Edonkey, WinMX or any other p2p file sharing application that demands high bandwidth and cpu resources. Use of these services negatively effects everyone on the main hardware node and will not be permitted.
  12. Is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to TruDigits; or
  13. Is otherwise malicious, fraudulent, or may result in retaliation against TruDigits by offended viewers

Content "published or transmitted" via TruDigits' service includes Web content, e-mail, bulletin board postings, chat, and any other type of posting or transmission that relies on any Internet service provided by TruDigits.

Security

You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically.

Updating Content Management Systems (CMS), Blogs and Other Scripts

It is mandatory that you run on the latest stable release of any commercial or opensource script you have on your domain. All CMS sites (Drupal, Joomla e.t.c) must be running on the latest stable release of the respective CMS.

We reserve the right to suspend your account/site if you are running outdated software and have ignored prior warnings to update it.

Security Consciousness

Ensure all scripts on your account are properly coded to optimise security. We STRONGLY recommend you do not use or build scripts that store passwords in the database as clear text. Ensure you escape HTML user inputs and explicitly declare filenames to include when using PHP includes for your navigation.

We are doing our best to ensure the environment is secure for everyone and consistently review our server hardening practice. We will not be held responsible for any damages or loss caused as a result of your coding negligence. Hacked sites will be suspended until the root cause is known AND fixed.

Bulk Commercial Email

You are not allowed to send bulk commercial emails on Shared and Reseller hosting plans. Bulk Commercial mailing is only allowed on the VPS Hosting plans and you must obtain TruDigits' advance approval for any bulk commercial mailing activities, which will not be given unless you are able to demonstrate all of the following to TruDigits' reasonable satisfaction:

  1. Your intended recipients have given their consent to receive e-mail via some affirmative means, such as an opt-in procedure.
  2. Your procedures for soliciting consent include reasonable means to ensure that the person giving consent is the owner of the e-mail address for which the consent is given.
  3. You retain evidence of the recipient's consent in a form that may be promptly produced on request, and you honor recipient's and TruDigits' requests to produce consent evidence within 72 hours of receipt of the request.
  4. The body of the e-mail must describe how the e-mail address was obtained, for example, "You opted in to receive this e-mail promotion from our Web site or from one of our partner sites," and information on how to request evidence of the consent, for example, "If you would like to learn more about how we received your e-mail address please contact us at abuse@**yourdomain.com**.
  5. You have procedures in place that allow a recipient to easily revoke their consent - such as a link in the body of the e-mail, or instructions to reply with the word "Remove" in the subject line. Revocations of consent are honored within 72 hours, and you notify recipients that their revocation of their consent will be honored in 72 hours.
  6. You must post an abuse@**yourdomain.com** e-mail address on the first page of any Web site associated with the e-mail, you must register that address at abuse.net, and you must promptly respond to messages sent to that address.
  7. You must have a Privacy Policy posted for each domain associated with the mailing.
  8. You have the means to track anonymous complaints.
  9. You may not obscure the source of your e-mail in any manner. Your e-mail must include the recipients e-mail address in the body of the message or in the "TO" line of the e-mail; and
  10. You otherwise comply with the CAN SPAM Act and other applicable law.

These policies apply to messages sent using your TruDigits' service, or to messages sent from any network by you or any person on your behalf that directly or indirectly refer the recipient to a site hosted via your TruDigits service. In addition, you may not use a third party e-mail service that does not practice similar procedures for all its customers. TruDigits may test and otherwise monitor your compliance with its requirements, including requesting opt-in information from a random sample of your list at any time.

Unsolicited E-Mail

You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated that they do not wish to receive it. You must comply with the rules of any other network you access or participate in using your TruDigits' services.

Material Protected by Copyright

You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless:

  1. You have been expressly authorized by the owner of the copyright for the work to copy the work in that manner.
  2. TruDigits will terminate the service of repeat copyright infringers

Redirection

We do not allow any form of redirection to banking, legal, news or Government websites. Redirection to any other kinds of sites will be approved on completion of the verification process.

Copyright Infringement Notice (Digital Millennium Copyright Act)

If you believe your copyright is being infringed by a person using the TruDigits' network, please send your written notice of copyright infringement to abuse@trudigits.com

Newsgroup, Chat Forums, Other Network

You must comply with the rules and conventions for postings to any bulletin board, chat group or other forum in which you participate, such as IRC and USENET groups including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages, or mass postings to multiple forums.

WordPress Usage & Modules

We do not allow any WordPress caching modules on our shared or reseller hosting services. WordPress caching modules continually cause server overload problems and are only allowed on VPS Plans.

In General

  1. No script or piece of software may use 35% or more of system resources for 60 seconds or longer
  2. No user may have above 10,000 opened files at any moment (the limit does not apply to overall number of existing files, owned by the user)
  3. Running stand-alone, unattached server side processes/deamons is strictly prohibited
  4. Running any type of web spider / indexer (Google Cash / Ad Spy) is strictly prohibited
  5. No mass mailing scripts allowed on TruDigits servers or emails accounts provided by TruDigits (except otherwise stated for any particular service)
  6. Running any bit-torrent / P2P application is strictly prohibited
  7. Running cron jobs with intervals of less than 10 minutes is strictly prohibited
  8. Running of public file exchange services is strictly prohibited
